ZONING NON-CONTRAVENE REQUEST
The Coastal Construction Control Line (CCCL) defines that portion of the beach and dune system subject to severe fluctuations based on a 100-year storm event and establishes the landward limit of jurisdiction of the Department of Environmental Protection (DEP) along sandy beaches of the State which front on the Gulf of Mexico, the Atlantic Ocean, and the Straits of Florida. Unless other wise exempt, a permit is required from DEP for construction and excavation activities seaward of the CCCL. The CCCL is not a seaward limit for construction of upland structures (as in a setback line), but is an area wherein special siting and design considerations are necessary to protect the beach – dune system, proposed or existing structures, adjacent properties, public beach access, native salt – tolerant coastal vegetation, and marine turtles.
To submit electronically for a zoning non contravene letter (preconstruction CCCL application), the following documents are required:
- Application: Fully completed Non-Contravene request form.
- Site-Plan/Survey: Detailed site-plan/survey depicting exact location of the proposed structure, with CCCL clearly labeled. All setbacks from front, sides and rear / CCCL delineated and labeled.
- Elevation Drawings: Detailed elevation drawings (all sides) depicting proposed height of structure (to the peak/highest point) from grade and NAVD (may not exceed 40ft).
- Payment Method: Payment for electronically submitted zoning non-contravene letter request must be in the form of credit card using an authorization form. A $1.50 (3%) will be added to the $50.00 application fee.
Alternatively, applicants may send the above information on a CD-ROM with a check in the amount of $50.00 payable to the City of Bonita Springs.
